BLOG – “Please, NO more social media blunders!”

At our June breakfast we delved into what quickly unfolded as a complex world of staff use of social media and the impact this has on a brand.

Katy Wedderburn, Partner with MacRoberts and specialist in Employment Law discussed protecting the brand, be it dealing with defamation, misconduct and cyber bullying and striking a balance between legitimate business interests and invasion of privacy.

Katy posed the question “how do we protect our brand when”:

  • Staff move to work for competitors
  • There is conduct outside the workplace
  • Staff use social media after hours

We were shown some examples where organisations brands were jeapodised by employees posting damaging remarks on social media about the organisation and in some cases the employee was dismissed. They later took the organisation to an unfair dismissal tribunal and won. Despite the negative and damaging remarks made by the employee the organisation was found at fault for not having appropriate guidelines in their social media policy – the breakfast audience were genuinely surprised that the employee won!!

Katy explained that it is crucial employees know the boundaries and that they are written into company policy and then linked to any disciplinary procedures the business has.

We were then told about the risk of discrimination amongst employees and how this impacts on the individual as well as the business. “A businesses best defense” says Katy “is to tell staff in the outset what conduct is and isn’t acceptable”

The presentation also touched on human rights and a persons right to be outspoken but also their right to privacy, equality and justice often adding to the complexity of a case.

Katy’s presentation and depth of knowledge and experience left no stone unturned and the audience in no doubt with regards to the importance of a water-tight social media policy – a topic that certainly fuelled a lively Q&A afterwards.
